The authorization list (REACH Annex XIV) groups together substances whose use is prohibited in the European Economic Area.

Substances subject to authorization

Companies must obtain authorization to continue using substances subject to authorization after a specified expiry date. This measure aims to reduce the use of substances of concern and encourage the development of safer solutions.

Inclusion in the list:

  1. Substances are selected for their high health or environmental risks, from those recommended by ECHA on the basis of the candidate list.
  1. The decision to add a substance is taken by the European Commission and published in the Official Journal of the EU.

Consequences for users:

  1. Application for authorization: Companies must submit an application by the specified deadline (LAD1), justifying the use and demonstrating risk management.
  1. Prohibition of use without authorization: Any use after the expiry date (Sunset Date2) is prohibited without a positive decision from the European Commission.
  1. Operational impact: Search for alternatives, administrative costs and delays linked to the authorization process.

1LAD (Last Application Date) : The deadline for submitting an authorization dossier for an industrial company wishing to extend the use of a substance included on the authorization list (Annex XIV of REACH). Compliance with this deadline enables an authorization applicant to benefit from the transitional provisions which guarantee the possibility of using a banned substance until there is a vote by the commission, even if this vote takes place after the substance's sunset date.

2Sunset Date : The sunset date is the date after which the use or placing on the market of the substance is prohibited, unless a specific authorization has been granted. This date marks the end of the transitional period for companies that have not obtained authorization.
